You may be eligible for the 3rd preference of employment-based immigrant, if you are a skilled worker, professional, or other worker (unskilled worker).

 

Skilled Worker

1. Requirements:

----- Your job must require a minimum of 2 years training or work experience, not of a temporary or seasonal nature.

----- You must demonstrate at least 2 years of job experience or training.

----- You employer must demonstrate that qualified workers are not available in the U.S. for the work you will be performing.

Professional

1. Requirements:

----- Your job must require at least a U.S. baccalaureate degree or a foreign equivalent (a baccalaureate degree has to be the normal requirement for entry into the occupation in the U.S.).

----- You must demonstrate that you possess a U.S. baccalaureate degree or foreign degree equivalent (education and experience may NOT be substituted for a baccalaureate degree).

----- You must be a member of the profession.

----- You employer must demonstrate that qualified workers are not available in the U.S. for the work you will be performing.

Other Worker (Unskilled Worker)

1. Requirements:

----- Your job must consist of unskilled labor requiring less than 2 years of training or experience, not of a temporary or seasonal nature.

----- At the time the I-140 petition is filed by your potential employer, you must be capable of performing the unskilled labor.

----- You employer must demonstrate that qualified workers are not available in the U.S. for the work you will be performing.
